1. A good sales contract<\/strong><\/strong><\/h6>\n\n\n\n

Do not hesitate to call one of our Marine Advisors for your sale contract !<\/p>\n\n\n\n

Boat sales can cause many disputes; that is why, to ensure peace of mind and avoid any misunderstanding, it is important that a good sale contract, detailed and specifically adapted to your transaction be written.<\/p>\n\n\n\n

Your Marine Advisor, well aware of such transactions, will help you and will produce with you a good sale contract.<\/p>\n\n\n\n

Your contract will be prepared carefully and will contain all relevant details of the transaction: price, guaranteed payment, terms, special agreements, etc.<\/p>\n\n\n\n

The amounts paid will be placed in escrow for the protection of all parties.<\/p>\n\n\n\n

The seller will rest assured that he will be paid when everything is in good standing and the buyer will know that his money is safe.<\/p>\n\n\n\n

Your Maritime Advisor will also ensure that existing debts, if any, are settled as they should.<\/p>\n\n\n\n

Sale and purchase of vessels transactions are different from those for cars or houses.<\/p>\n\n\n\n

An estimate of fees from your Marine Advisor will be communicated to you before any procedure is started on your behalf.<\/p>\n\n\n\n

2. Licence or registration?<\/strong><\/strong><\/h6>\n\n\n\n

A boat displaying a number on the hull such as 10D12345 or ON12345 has a licence.<\/p>\n\n\n\n

The licence is not a proof of ownership.<\/p>\n\n\n\n

The certificate of registry represents a valid title.<\/p>\n\n\n\n

It helps to confirm the ownership of the vessel.<\/p>\n\n\n\n

It allowes maritime mortgages (good interest rates, etc.).<\/p>\n\n\n\n

The name of the boat and the port of registry are written on its hull. A carving plate displaying the registration is fixed inside.<\/p>\n\n\n\n

In all cases, a Search on titles is required to ensure the seller\u2019s quality of the title and to find out if some debts exist on the boat.<\/p>\n\n\n\n

Some buyers have learned too late that a creditor had a security against the boat they bought and paid.<\/p>\n\n\n\n

3. Marine broker<\/strong><\/strong><\/h6>\n\n\n\n

In contact with many sellers and buyers, he may act as a mediator in the negotiations of selling prices, list of equipment and delivery condition. The boats sold do not belong to him. The sale is between individuals, seller and buyer.<\/p>\n\n\n\n

Each sale is a special case and a good sale contract, including all the relevant details to the transaction, should always be prepared. You will never regret working with one of our Marine Advisors.<\/p>\n\n\n\n

4. Transaction in a foreign country<\/strong><\/strong><\/h6>\n\n\n\n

If the vessel is registered in another country (e.g.: the United States – Certificate of documentation, France – Acte de francisation, etc.), the transfer of ownership must be completed under the rules and conditions of the foreign authorities as well as the Canadian authorities; otherwise, even though you have the boat in your possession, your seller remains the sole official owner.<\/p>\n\n\n\n

The above comment is to be seriously considered for any purchase or sale with someone other than a Canadian, whether the vessel is sailing or not in Canada.<\/p>\n\n\n\n

Verification, in the foreign country, on the vessel and on its owner is important to ensure the transfer terms, the seller property quality of title and the debts possibly existing against the vessel.<\/p>\n\n\n\n

5. Transactions too fast<\/strong><\/strong><\/h6>\n\n\n\n

Sales between individuals \u2013 Too Quick Transactions<\/p>\n\n\n\n

Take your time ! Calculate ! Ask questions ! Get answers !<\/p>\n\n\n\n

Be carefull when your seller tells you:<\/p>\n\n\n\n

I am honest and without blame…!<\/p>\n\n\n\n

He has a list of people who want to buy his boat…!<\/p>\n\n\n\n

Take it or leave it !<\/p>\n\n\n\n

Complex contracts are a waste of time and money…!<\/p>\n\n\n\n

Acting without taking all required precautions may end up with no boat and an empty bank account.<\/p>\n\n\n\n

Is it a risk to take ?<\/p>\n\n\n\n

It may be a disaster, when:<\/p>\n\n\n\n

The boat secures undisclosed loans<\/p>\n\n\n\n

The property title of the seller is not compliant<\/p>\n\n\n\n

The seller has no time to put his promises in writing<\/p>\n\n\n\n

The seller dies in the meantime<\/p>\n\n\n\n
